Halloween is always an interesting season to me. Seemingly normal folk suddenly turn into prop masters, putting all manner of items in yards that, eleven months out of the year, would qualify for garden club awards.

We are no different. I currently have a full fenced cemetery - complete with a full size horse drawn hearse - in anticipation of Halloween night when I construct a full haunted mansion themed haunted house. It’s also the season when I start focusing on clients working to get their estate plans finished before year’s end, made even more urgent by the pending estate-plan price increase.

Zombie accounts are those social media accounts whose user has already passed on. Their accounts are sadly frozen in time because there is no one with access to close them. Their photos stored on the cloud linger, their handle is searchable, and occasionally the algorithm recommends them as friends in my feed, which is a bit creepy when I know that I went to their funeral years ago.

Handling digital assets is a relatively new legal need, and most social media companies do not accept an executor named in a simple Will as the authorized person to wind up the affairs of the deceased.

This is where the Digital Asset Survivor language comes in. Until recently, it was a separate form that I included in my estate plans, and now it is a clause within the Will itself. The provision names the Executor, or another person, as the custodian of Digital Assets to dispose of them in accordance with your wishes.

As a rule of thumb, if your will is 10 years old, or you have experienced a life change (birth, death, kids turning 18, etc.) you should have an updated will prepared. If not, you should get a Digital Asset Survivorship document ASAP.
